2.1 Acceptance

By accessing or using the Service, you declare that you:

• Have read, understood, and fully accept these Terms of Service
• Are legally capable of entering into contracts
• Are at least 16 years old or have parental/guardian consent
• If acting on behalf of an organization, are authorized to bind that organization

2.2 Modifications

The Provider reserves the right to modify these terms. Substantial changes will be announced at least 30 days in advance via the website or email. Continued use after notification constitutes acceptance.

3. Description of Service

3.1 Nature of Service

WetWijzer/LisLoi is an unofficial research and information platform on Belgian legislation. The Service includes:

• Legislative database: Searchable collection of Belgian laws, decrees, ordinances, and orders
• Case law database: Searchable collection of published judicial decisions
• Parliamentary documents: Searchable collection of Chamber and Senate documents
• AI Chatbot: Automated system for answering legal questions

3.2 Sources and Currency

Information comes from public sources including the Belgian Official Gazette, Justel, EUR-Lex, and other official publications. We aim for regular updates but do not guarantee all information is current.

4. No Legal Advice

4.1 Informational Purpose

All information on the Service is intended for general informational purposes only. No attorney-client relationship is created by using the Service.

4.2 Professional Advice Required

For your specific legal situation, you should always consult a qualified lawyer or legal advisor. The Provider is not a law firm and does not provide legal services.

4.3 No Guarantee of Accuracy

Legal information may:

• Be outdated, incomplete, or misinterpreted
• Not apply to your specific situation
• Differ from the most recent legislation or case law
• Lack regional or sector-specific nuances

5. Disclaimers and Warranties

5.1 "As Is"

The Service is provided "as is" and "as available", without any warranties of any kind, express or implied.

5.2 AI-Specific Disclaimers

The AI chatbot:

• Uses artificial intelligence that may "hallucinate" (present incorrect information as fact)
• Has no real-time knowledge of recent legislative changes
• May misinterpret or misapply legal concepts
• Does not provide individualized advice
• May cite non-existent laws, articles, or judgments

Always verify chatbot responses with official sources or a legal professional.

6. Limitation of Liability

6.1 Exclusion of Liability

To the extent permitted by applicable law, the Provider is not liable for:

• Direct damages: Arising from use or inability to use the Service
• Indirect damages: Including loss of profits, revenue, goodwill, or data loss
• Consequential damages: Including damages resulting from decisions based on Service information
• Third-party damages: Acts or omissions of AI providers, payment processors, or hosts

6.2 Maximum Liability

If the Provider is held liable despite the above, total liability is limited to the amount you paid for the Service in the 12 months preceding the damage, with a maximum of €100.

6.3 Force Majeure

The Provider is not liable for failures due to force majeure, including: hosting or cloud provider outages, cyberattacks, natural disasters, war, strikes, government measures, or other circumstances beyond reasonable control.

7. Usage Rules

7.1 Permitted Use

You may use the Service for:

• Personal consultation of legislation and case law
• Educational and research purposes
• Professional information gathering (within fair use limits)

7.2 Prohibited Use

It is prohibited to:

• Overload the Service through automated requests, scraping, or bots
• Circumvent rate limits or security measures
• Disrupt or damage infrastructure
• Reverse engineer, decompile, or extract source code
• Use the Service for illegal activities
• Create multiple accounts to circumvent limits
• Abuse the AI chatbot to generate misleading or harmful content

8. Artificial Intelligence

8.1 AI Technology

The AI chatbot uses large language models (LLMs) provided by Azure OpenAI Services. This technology:

• Generates responses based on patterns in training data
• Is not deterministic - the same question may yield different answers
• Can generate convincing but factually incorrect information ("hallucinations")

8.2 No Training on Your Data

Your conversations with the chatbot are not used to train AI models. Azure OpenAI only stores prompt data temporarily for abuse monitoring (maximum 30 days) and does not use it for model improvement.

8.3 Human Verification Required

Any AI chatbot output should be considered a starting point for research, not a definitive answer. Human verification remains necessary.

9. Intellectual Property

9.1 Legislation

Belgian legislation and case law are in the public domain and not subject to copyright protection.

9.2 Software

WetWijzer/LisLoi software is MIT licensed and open source. See our GitHub repository for source code and license terms.

10. Accounts and Payments

10.1 Credit Packages

WetWijzer/LisLoi offers a credit-based payment model:

• One-time purchase: Credits do not auto-renew
• No expiration: Purchased credits do not expire
• Non-transferable: Credits are tied to your account
• Non-refundable: Purchased credits are not refundable

10.2 Pricing

All displayed prices are VAT inclusive (21%). Prices may change; existing credits remain valid at their purchase value.

10.3 PEPPOL Electronic Invoicing

Business clients with a Belgian VAT number receive invoices via the PEPPOL network in accordance with Belgian mandatory B2B electronic invoicing law.

11. Consumer Rights

If you are a Consumer, you benefit from Belgian and European consumer law protection.

11.1 Applicable Legislation

11.2 Right of Withdrawal

For digital services with immediate access, an exception applies. Under Book VI ELC, your withdrawal right expires when you:

• Give explicit consent for the service to start immediately
• Acknowledge that you thereby lose your right of withdrawal

As a Consumer, you have access to:

• Consumer Mediation Service (Belgium)
• Online Dispute Resolution Platform (EU)

12. Termination

You can delete your account at any time via your account page. Unused credits are not refunded.

13. Governing Law and Disputes

These terms are governed by Belgian law, excluding the Vienna Sales Convention. Disputes shall be submitted to the courts of Brussels, Belgium.

14. Final Provisions

14.1 Entire Agreement

These terms, along with the Privacy Policy, constitute the entire agreement between you and the Provider regarding the Service.

14.2 Severability

If any provision is declared invalid, the remaining provisions remain in effect.

15. Donations

WetWijzer/LisLoi accepts voluntary donations:

• Voluntary: Donations are optional and not required
• Non-refundable: Donations are final
• No consideration: Donations do not grant special rights or access
• No tax benefit: WetWijzer/LisLoi is not a registered non-profit; donations are not tax-deductible
