25 NOVEMBRE 2015. - Arrêté royal portant modification de l'arrêté royal du 22 janvier 1998 réglementant certaines substances psychotropes, et relatif à la réduction des risques et à l'avis thérapeutique
Art. 1-11
Article 1er. Dans l'article 1er de l'arrêté royal du 22 janvier 1998 réglementant certaines substances psychotropes, et relatif à la réduction des risques et à l'avis thérapeutique, le 1) est remplacé comme suit :
" 1) " substances psychotropes " :
-les substances visées aux articles 2, 25 et 38 du présent arrêté, leurs stéréo-isomères (à l'exception de ceux de la cathine), leurs sels, en ce compris les sels des stéréo-isomères, dans le cas où ces stéréo-isomères et sels peuvent exister d'un point de vue chimique.
- Les préparations contenant ces substances, stéréo-isomères ou leurs sels; "
Art.2. L'article 2, § 1er, a) du même arrêté est complété par les mots suivants :
"
- 25I-NBOMe [2-(4-iodo-2,5-dimethoxyphenyl)ethyl][(2-methoxyphenyl)methyl]amine;

Art.3. L'article 2, § 1er, b) du même arrêté, modifié par les arrêtés royaux des 30 avril 2002 et 18 octobre 2004 est complété par les mots suivants :

Art.4. Dans l'article 2, § 1er du même arrêté, le c) est inséré, rédigé comme suit :

Art.5. Dans l'article 2, § 2 du même arrêté, modifié par les arrêtés royaux des 16 novembre 1999, 30 avril 2002, 18 octobre 2004, 22 octobre 2006, 13 juin 2010, 26 septembre 2011, 20 mars 2013 et par la loi du 23 décembre 2009, modifiée à la suite de l'arrêt du Conseil d'Etat n° 196.675 du 6 octobre 2009, les modifications suivantes sont apportées :

Art.6. Dans l'article 18 du même arrêté, le § 1er est remplacé comme suit :
" § 1er Sans préjudice de l'autorisation prévue à l'article 3, § 1er, toute importation d'une substance psychotrope est soumise à l'autorisation préalable du Ministre.
Cette disposition ne s'applique ni :
- Au transport par les voyageurs internationaux de petites quantités de médicaments contenant des substances psychotropes qu'ils ont acquis légalement, destinés à leur usage personnel.
- Aux trousses de premiers secours des navires, aéronefs ou autres moyens de transport publics effectuant des transports internationaux et renfermant des médicaments contenant des substances psychotropes.
- A l'importation de petites quantités de substances psychotropes listées à l'article 2, § 2, destinées à des fins analytiques ou scientifiques; "
Art.7. Dans l'article 20 du même arrêté, le § 1er est remplacé comme suit :
" § 1er. Sans préjudice de l'autorisation prévue à l'article 3, § 1er, toute exportation d'une substance psychotrope est soumise à l'autorisation préalable du Ministre. Cette disposition ne s'applique ni :
- Au transport par les voyageurs internationaux de petites quantités de médicaments contenant des substances psychotropes qu'ils ont acquis légalement, destinés à leur usage personnel.
- Aux trousses de premiers secours des navires, aéronefs ou autres moyens de transport publics effectuant des transports internationaux et renfermant des médicaments contenant des substances psychotropes.
- A l'exportation de petites quantités de substances psychotropes listées à l'article 2, § 2, destinées à des fins analytiques ou scientifiques. "
Art.8. L'article 25 du même arrêté, modifié par les arrêtés royaux des 16 novembre 1999, 30 avril 2002, 26 septembre 2011 et 20 mars 2013 est remplacé par ce qui suit :

§ 2. Les présentes dispositions s'appliquent également aux substances psychotropes suivantes :
- ETIZOLAM : 7-(2-chlorophenyl)-4-ethyl-13-methyl-3-thia-1,8,11,12-tetraazatricyclo[8.3.0.0|F2,6]trideca-2(6),4,7,10,12-pentaene
- NALBUPHINE: 4-(cyclobutylmethyl)-12-oxa-4-azapentacyclo[9.6.1.0|F1,|F1|F3.05,17.07,18]octadeca-7(18),8,10-triene-10,14,17-triol "
Art.9. Dans l'article 31 du même arrêté, le § 1er est remplacé comme suit :
" § 1er. Sans préjudice de l'autorisation prévue à l'article 26, § 1er, toute importation d'une substance psychotrope est soumise à l'autorisation préalable du Ministre.
Cette disposition ne s'applique ni :
- Au transport par les voyageurs internationaux de petites quantités de médicaments contenant des substances psychotropes qu'ils ont acquis légalement, destinés à leur usage personnel,
- Aux trousses de premiers secours des navires, aéronefs ou autres moyens de transport publics effectuant des transports internationaux et renfermant des médicaments contenant des substances psychotropes.
- A l'importation de petites quantités de substances psychotropes listées à l'article 25, § 2, destinées à des fins analytiques ou scientifiques. "
Art.10. Dans l'article 33 du même arrêté, le paragraphe § 1er est remplacé comme suit :
" § 1er Sans préjudice de l'autorisation prévue à l'article 26, § 1er, toute exportation d'une substance psychotrope est soumise à l'autorisation préalable du Ministre.
Cette disposition ne s'applique ni :
- Au transport par les voyageurs internationaux de petites quantités de médicaments contenant des substances psychotropes qu'ils ont acquis légalement, destinés à leur usage personnel,
- Aux trousses de premiers secours des navires, aéronefs ou autres moyens de transport publics effectuant des transports internationaux et renfermant des médicaments contenant des substances psychotropes.
- A l'exportation de petites quantités de substances psychotropes listées à l'article 25, § 2, destinées à des fins analytiques ou scientifiques. "
Art. 11. Notre Ministre de la Santé publique est chargé de l'exécution du présent arrêté.
